Are You Ready For An ICE Storm?

President Trump appears to have started his promised crackdown on undocumented aliens in the United States by signing three executive orders in January, followed by the Department of Homeland Security issuing two implementing memoranda in February. Those orders call for the hiring of 10,000 new Immigration and Custom Enforcement (ICE) agents and directs the Department of Homeland Security to deputize local and state officers to enforce federal immigration laws. The orders and President Trump’s campaign promises suggest employers will face increased ICE I-9 audits, investigations, and possibly even workplace raids similar to those during President Bush’s administration. These raids and audits pose greater financial consequences since the government recently increased the fines associated with I-9 violations. To make matters more complicated, the Department of Justice recently issued a proposed rule expanding the anti-discrimination provisions applicable to the I-9 process, and we expect additional executive orders or legislation will affect Travel, Deferred Action for Childhood Arrivals (DACA) and the H1-B visa program along with other visa programs.

During this presentation, Mike Palmer and Mercedes Badia-Tavas will discuss:

  • Recent and expected changes to immigration law through executive orders and implementing memoranda
  • How these developments affect employers
  • The elements of an immigration compliance program, including I-9 employment verification, immigration status requirements and travel/entry issues
  • How to prepare for increased worksite enforcement by ICE

The speakers are attorneys who practice in the firm’s Immigration and Global Mobility Practice Group. Mercedes is also the current chair of the Chicago Chapter of the American Immigration Lawyers Association (AILA Chicago).
